Term & Conditions
l1. The Contract
The contract is established between the client (the person booking or intending to travel) and Andean Diaries Travel Peru EIRL. Booking through our website, via email, by phone, or through any other means constitutes agreement to these Terms and Conditions. This document represents the entire agreement between both parties and supersedes all prior verbal or written communications.
Note: These Terms and Conditions apply only to services provided by the Company and do not include international flights, which are governed by airline policies.
✈️ Note on Domestic Flights
These Terms and Conditions apply to services provided directly by Andean Diaries Travel Peru EIRL, and do not apply to international flights.
Domestic flights within Peru may be included in your itinerary depending on the package selected. When included, they are subject to the terms and conditions of the airline operating the service. If you would like assistance with flight arrangements, payment for flights must be made immediately upon confirmation, as airfare prices and availability are highly variable.
2. Reservation and Payment
To secure your booking, a completed reservation form and deposit payment are required. We recommend making your reservation at least 30 days before your travel date.
The reservation becomes binding once the deposit is received and confirmed by the Company. The Company reserves the right to reject any booking at its sole discretion.
3. Client Information
To confirm your reservation, you must provide the following personal information no later than 30 days prior to the trip:
- Full name
- Passport number and copy
- Date of birth
- Nationality
- Medical form (if applicable)
- International flight details
- Emergency contact information
4. Final Payment and Surcharges
Final payment is required at the start of the tour. To avoid surcharges, we recommend booking in advance and avoiding last-minute hotel or itinerary changes.
5. Changes to Your Reservation
If changes are requested up to 30 days before departure, a US$50 administration fee per person applies. Changes requested less than 30 days before departure will be treated as cancellations.
If you are unable to travel and notify us at least 20 days in advance with a valid reason, we may offer to transfer your reservation to another traveler or provide a refund minus 20% (10% for administrative costs, 10% for transfer fees). Refunds will be processed within 15 days.
6. Changes by the Company
We reserve the right to make changes to itineraries, services, or prices due to factors beyond our control. Clients will be informed of any changes as soon as possible. Itinerary adjustments may occur if deemed necessary by the Company.
7. Cancellation Policy
- Up to 30 days before departure: 50% cancellation fee
- 8 to 1 days before departure: 100% cancellation fee
Note: Airline tickets (commercial or charter) are non-refundable. However, they remain valid for 1 year and may be reused by the original traveler, subject to airline penalties and fare differences.
8. Travel Insurance
Travel insurance is strongly recommended. It should include coverage for:
- Medical emergencies
- Repatriation and evacuation
- Trip cancellation or curtailment
- Personal liability
Clients declining insurance must sign a waiver and assume all associated risks and costs.
9. Medical Form
If you have a pre-existing condition, a completed and signed medical form (approved by a licensed physician) must be submitted no later than 15 days before the trip.
10. Financial Protection
Andean Diaries Travel Peru EIRL is fully registered with the Ministry of Tourism and complies with applicable financial protection regulations for client funds.
11. Client Responsibilities
Clients must comply with the instructions of Company staff and guides. The Company reserves the right to exclude any person whose behavior compromises safety, comfort, or enjoyment of the group.
Clients are responsible for obtaining and carrying all necessary travel documents (e.g., valid passport, visas, vaccination certificates). Passports must be valid for at least 6 months beyond your travel return date.
12. Company Responsibilities
While we strive to ensure a seamless experience, you acknowledge that adventure travel involves inherent risks. The Company will act with due diligence but cannot be held responsible for unforeseen events such as:
- Force majeure
- Weather disruptions
- Natural disasters
- Transportation delays
- Third-party failures
13. Flight Delays and Disruptions
We are not liable for flight delays or cancellations caused by:
- Weather
- Airline rescheduling
- Technical issues
- Strikes
- Air traffic control decisions
We will make reasonable efforts to adjust your itinerary if affected.
14. Children’s Policy
Unless otherwise stated, child rates apply to travelers under 12 years of age. Those 12 and older are considered adults and are charged accordingly.
15. Last-Minute Reservations
Bookings made within 10 days of departure incur a US$50 last-minute fee to cover urgent processing and logistics.
16. Complaints and Claims
Any complaint must be reported to our local representative at the time of the issue. Failure to report on-site may affect your ability to claim compensation. Formal complaints must be submitted in writing within 28 days of your return.
17. Acknowledgment and Consent
By signing the reservation form or proceeding with a booking, you confirm that you have read, understood, and accepted these Terms and Conditions.
